REGULATIONS, ACCORDING TO ARTICLE 11, PRESIDENTIAL DECREE NO. 430, 26 OCTOBER 2001, FOR THE PRIZE COMPETITION “WIN THE X FACTOR FINAL WITH 24BOTTLES”
between


1. Sponsor
The Sponsor Company is Design24 Società Benefit S.r.l., in the person of its legal representative pro tempore, Mr Giovanni Randazzo, with head office in Via Arturo Toscanini No. 9, 40055 Castenaso (BO), VAT No. 03283301202.

2.Authorised Person

Attorney Chiara Doplicher, with chosen domicile for the office at the Law Firm Vittori Rigosi, with head office in Via Guerrazzi No. 18, 40125 Bologna, Tax Code DPLCHR87H49A703Y, VAT 03927160246.

3.The Prize Competition is named “Win the X Factor final with 24Bottles”.

4.Intended Audience

The intended competitors for the competition are all adult end consumers, resident or domiciled throughout this competition in Italy or in the Republic of Sam Marino.
Those who collaborate with and/or employed by the sponsor company and all those involved in organising and managing the competition are excluded from taking part.

5.Duration of the competition
From 15 September 2019 to 31 December 2019.
The final prize draw is expected by 18 November 2019.

6.Sponsored Products – Objective of the competition

The sponsored brand is 24Bottles and the sponsored products are Urban Bottle and Clima Bottle sold on the Internet website www.24bottles.com .
This competition is being held with the intention of increasing the visibility of the sponsored brand and, more specifically, of encouraging the purchase of the sponsored products.

7. Participation procedure

All consumers, resident or domiciled in Italy or in the Republic of San Marino, who throughout the period of the competition purchase a bottle of Urban Bottle and/or Clima Bottle (reusable, 18/8 steel bottle) on the Internet website www.24bottles.com will, in the event of a purchase, receive an order confirmation e-mail giving a unique code at the bottom, valid to take part in this competition. One game code will be issued for each 24Bottles product in the Urban Bottle and Clima Bottle range purchased on-line up to a maximum of 3 codes for each order completed (e.g. for 3 urban bottles purchased in the same order, 3 codes per order will be issued). Each user may provide a number of 3 user codes and, therefore, take part in the competition a maximum of 3 times.
To compete in the prize draw, the consumer will have to connect to the website www.24bottles.com and complete the participation form, by entering his/her personal details and the unique participation code in the order confirmation e-mail.
If the address of the participant’s residence or domicile is missing, or if his/her personal data is missing or incorrect, participation in the competition will be void and the consumer will, therefore, be automatically excluded.
No. 5 winners will be drawn at the end of the participation period.
N.B. The winner must keep the order confirmation e-mail giving the unique code, as he/she will be requested to send it to the Sponsor Company (we advise you to keep the order confirmation e-mail for up to 180 days from the date of extraction).

8.Restrictions on participation
Each code may be used only once. Underage consumers may not take part in the competition.

9.Prize draw procedure

5 winners and 5 runners-up from among the participants in the competition, whose form arrives no later than 12:00 a.m. on 15/11/2019, will be randomly drawn in the presence of a Notary Public or consumer protection and public faith supervisor competent for the territory (Article 9, Presidential Decree No. 430, 26 October 2001). The winner will be given a pair of tickets to attend the X Factor final and a kit of 24Bottles products, consisting of: 1 pack of reusable stainless steel straws, 1 sports lid, 1 pack of party cups – 4 cups. Each participant may not be awarded more than one prize.
N.B. If the Sponsor Company deems it necessary in order to award the prize, it may ask the winner for a copy of his/her identity card or other valid identification document to verify the details the winner entered on the competition form are true. If the data on the form and the data in the identification document do not match, the prize cannot be awarded.
The winner cannot dispute the prize awarded, or request the corresponding value in money or a change/replacement for any reason whatsoever. However, if the Sponsor is unable to award the prize which has been won, it reserves the right to replace the previously announced prizes with prizes of equal or higher value (point 9.6, circular 28/03/2002). The winners may not request any compensation for any damages resulting from accepting the prize.

10.Runners-up
5 names of runners-up will be drawn if, for any reason, it is impossible to award the prizes to the winners. Prizes which have not been awarded to the winners will be awarded to the runners-up in the order of the draw.

11.Prizes

The prizes consist of 5 pairs of tickets to attend the X Factor final and a kit of 24Bottles products, consisting of: 1 pack of reusable stainless steel straws (worth EUR 9.90), 1 sports lid (worth EUR 7.10), 1 pack of party cups – 4 cups (worth EUR 30.00). The tickets to attend the X Factor final are not on sale to the general public and, therefore, they have no direct market value. However, the value of a pair of tickets can be estimated at EUR 50.00.
The Kit of 24Bottles products, consisting of: 1 pack of reusable stainless steel straws, 1 sports lid, 1 pack of party cups – 4 cups is worth a total of EUR 47.00 (VAT included).

12.Nature of the prize

A pair of tickets to attend the final of the television show, the X Factor, and a kit of 24Bottles products, consisting of: 1 pack of reusable stainless steel straws, 1 sports lid, 1 pack of party cups – 4 cups.
The prize consists of 2 tickets to attend the final, LIVE episode of the television show, the X Factor (It will be televised from the television studios in Milan) and 1 kit of 24Bottles products, consisting of: 1 pack of reusable stainless steel straws, 1 sports lid, 1 pack of party cups – 4 cups.
Transport costs to the place where the prize-giving event will be held are at the expense of the end consumer, who shall, therefore, pay independently.
The date, place and time of the event are to be confirmed and the winner will be notified after the draw, as they could change for reasons beyond the sponsor’s control. Thus, all the information on how to claim the prize will be confirmed at the time the winner is notified of the win.
The prize does not include the winner’s travel from his/her place of residence to the place of the event and vice versa, or anything which is not explicitly specified.
The prize is non-transferable to third parties and entry to the studios is not permitted for persons under the age of 16. In any event, any minors may use the ticket only if accompanied by an adult with the permission of both parents/legal guardians.

13.Notification and prize-giving

The winners of the final draw will be notified by telephone and the notification will be repeated over five, even non-consecutive days, with No. 5 telephone calls per day. Furthermore, notification of having won the prize will also be sent via e-mail. The winners shall accept within 5 days from the first notification of the win. If there is no reply within the time indicated, they will be understood to be untraceable and their prize will be given to the runners-up (in the order of the draw). The runners-up shall comply with the same terms of acceptance.
Entry to the studios is not permitted for persons under the age of 16.
If the winner and the runner-up fail to accept, they will forfeit their right to the prize, which will be given to the Public Benefit Organisation named in the following point 16 of these regulations.
The organising company and its authorised person take no responsibility for any errors made by the winner when providing his/her personal data.
The prizes will be awarded in compliance with Article 1, paragraph 3, Presidential Decree No. 430/2001.
The Sponsor takes no responsibility if the prizes are not delivered due to incorrect addresses or personal data by participants or to postal misdeliveries.
The Sponsor takes no responsibility if the prizes are not delivered if the winner cannot be found via the participation telephone number.
The prizes will be delivered by post or courier directly to the winner’s address and/or any other address the latter indicates on acceptance of the prize within 180 days from the end of the event, in compliance not only with Article 1, paragraph 3, Presidential Decree No. 430/01, but also with the EU Regulation on the protection of personal data, EU 679/2016 (GDPR).
As the prize is delivered via carriers/forwarding agents (couriers, express couriers or post), the Sponsor or Authorised person is in no way responsible if the prize is delivered with the external packaging clearly tampered with, broken and/or damaged. If this should occur, it would be better to ascertain this at the time of delivery and not after signing the delivery note for the prize. Therefore, the winner, or whoever is authorised to take the prize on his/her behalf, is kindly asked to carefully check the prize package shows no signs of tampering, breakages or other, which makes them assume the Prize has been completely or partially damaged and/or completely or partially removed.
In the event of any reasonable doubt, the winner has the right to refuse the Prize giving a written reason, or to accept the Prize and reserve the right to verification. This reserve must be clearly indicated on the delivery note.

14.Participation free of charge
Participation in the competition is free of charge, except for any ordinary postal, telephone or Internet connection expenses required to participate.

15.Advertising for the competition and the Regulations

The Sponsor Company will advertise the competition on its Internet website and via its social media channels.
The advertising message will comply with what is stated in these regulations.

16.Territory

The competition will be valid throughout Italy and the Republic of San Marino.

17.Guarantees and obligations

Names of those participating in the competition will be collected from the website via computerised software, for which a special affidavit will be drawn up to guarantee the latter is operating correctly.
A suitable deposit will be provided to guarantee the entire prize money, in compliance with what is required by Article 7, Presidential Decree 430/2001.
This prize competition is held in compliance with Presidential Decree No. 430, 26 October 2001 and according to the instructions given in the Circular of the Ministry of Economic Development No. 1/AMTC, 28 March.
Participation in this prize competition involves the participant’s unconditional, total acceptance of the rules and clauses contained in these regulations without any restriction, including the value given for the prizes to be won.
In the event of obvious, detectable attempts of fraud and false, incorrect statements, the Sponsor reserves the right to immediately bar the user.
Users who, according to the unquestionable judgement of the Sponsor Company or third parties appointed by the latter, take part with means and instruments capable of eluding the random nature or, nevertheless, judged to be suspect, fraudulent or in breach of the normal implementation of the initiative will be excluded from participating and will be unable to enjoy any prize won.
Therefore, the Sponsor Company, or third parties it has appointed, reserve the right to proceed against all those participants in the most opportune manner (including, if deemed necessary, the request of identification documents) and according to the laws in force.
Participants’ data will be collected in compliance with EU legislation 679/2016 (GDPR).

18.Allocation of the Server
The competition database will be allocated to a server located in Italy, with head office in Italy.

19.Electronic and web tools
The Sponsor declines any liability for any problem of access, impediment, malfunction or difficulty regarding the technical tools, computer, telephone line, cables, electronics, software, hardware, transmission and connection, Internet connection, accessibility of the online game and the mobile and land telephone network, which may prevent a user from taking part in the competition.,
It also declines any liability for problems caused by the user’s computer/device configuration, which could affect the user’s performance during the game.

20.Subrogation
The Sponsor Company does not intend to exercise its right of subrogation at source envisaged by Article 30, Presidential Decree No. 600, 29/09/79 and accepts responsibility for the relevant tax charges.

21.Public benefit organisation as beneficiary
Contrary to any prizes which have been refused, any unclaimed or unassigned prizes will be given to FAI – [the National Trust for Italy] – Via Carlo Foldi No. 2, 20135, Milan, a non-profit Foundation, recognised with Presidential Decree 941 of 03/12/1975 – Register of Legal Persons, Milan Prefettura No. 86 – Tax Code 80102030154 – PEC [certified E-mail]: 80102030154ri@legalmail.it

22.Minors

Persons under the age of 18 cannot take part in the prize competition. The Sponsor Company reserves the right to request at any time the checks needed to ascertain the winner’s age.

23.Processing of Personal Data

As regards the information to be provided pursuant to Article 13, European Regulation 679/2016 (so-called GDPR), as updated by Legislative Decree No. 101/2018, according to the principles of lawfulness, correctness and transparency, the operations carried out on the personal data of those participating in the prize competition named “Win the X Factor final with 24Bottles” are described below.
Data Controller and purposes of processing
The Data Controller for the processing is: Design24 Società Benefit S.r.l., in the person of its legal representative pro tempore, with Head Office in Via Arturo Toscanini No. 9, 40055 Castenaso (BO), privacy@24bottles.com.
The Data Controller will process your personal data for the following purposes: “Participation of the data subject in the prize competition”.
The Data Controller will process the data collected via the special, on-line form on the website www.24bottles.com not only to manage all the phases of the prize competition named “Win the X Factor final with 24Bottles” set up by the Data Controller, but also to fulfil the resulting administrative-accounting and tax obligations according to law.
The legal basis, which authorises this processing, is the fulfilment of the obligations arising from the data subject’s participation in the prize competition, set up by the Data Controller, and the resulting legal obligations, to which the competition is subject.
The data will be kept throughout the event and for the time required to fulfil the obligations required by law and by the national and community regulations in force.
Provision of data
Provision of data is usually voluntary. However, partial failure to provide data or the provision of incorrect data may mean the data subject finds it impossible to register and participate in the prize competition and the Data Controller may be unable to fulfil the subsequent, contractual and legal obligations.
Categories of individuals to whom the data may be communicated (Recipients)
The data collected by the Data Controller will not be diffused, transferred and/or given to third parties, non-EU countries or international organisations. The participants’ personal data will be communicated to the Legal Office of Atty. Chiara Doplicher, in via Guerrazzi No. 18, 40125 Bologna, VAT 03927160246 for purposes connected with implementing the prize event.
The personal data will also be made available to the competent Consumer Protection and Public Faith Supervisor for the territory for whatever is required for the competition.
Place and Procedures to process the data
The data collected will be processed and kept via mainly digital procedures at the Data Controller’s registered office and solely by previously trained personnel authorised to process it, for the time required to achieve the purposes for which it was collected and no longer than the conservation period indicated.
The Data Controller complies with specific, technical, security measures to prevent the loss, diffusion and illegal or incorrect use of, or unauthorised access to the data.
Data Subjects’ Rights
Pursuant to the provisions of Articles 15-22, EU Regulation 2016/679, the individuals to whom the personal data refers have the right at any time to obtain confirmation of the existence or not of that data and to know the contents and origin, to check it is correct or to request its integration, update, or correction.
Data subjects also have the right to request not only the erasure and restriction of data processing, but also to oppose processing under any circumstance on legitimate grounds.
Lastly, the data subject also has the right to file a claim to the Italian Data Protection Authority, pursuant to Article 141, Legislative Decree No. 196 of 2013 and Article 77 of EU Regulation 2016/679.
